This End User License Agreement ("EULA") is a legal agreement between you and Therr, Inc., 8 The Green STE B, Dover, DE, 19901, United States ("Therr"), governing your installation and use of the Therr mobile and web applications (the "Software").
This EULA covers the software license only. Your use of the Therr service as a whole is governed by our Terms of Service, which include important provisions on dispute resolution, liability, and your content. Our Privacy Policy explains how we handle your personal information.
By installing or using the Software, you accept this EULA. If you do not accept it, do not install or use the Software. If you are accepting on behalf of an organization, you represent that you have authority to bind it.
Therr grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use one copy of the Software on devices you own or control, for your own personal or internal business use, in accordance with this EULA and the Terms of Service. This EULA also covers updates, supplements, and internet-based services we provide for the Software, unless those come with separate terms, in which case those terms apply.

The Software is licensed, not sold. Therr and its licensors retain all right, title, and interest in the Software, including all intellectual property rights in it and in any modifications or updates. All rights not expressly granted are reserved. This EULA gives you no rights in the Therr name, logo, or other marks.
The Software lets you and other users post content. Therr has zero tolerance for objectionable content and abusive users.
Objectionable content includes, without limitation: content that sexually exploits or endangers a child; realistic, graphic, or sadistic violence; threats, incitement to violence, harassment, or bullying; hate speech targeting protected characteristics; sexual content or nudity; content promoting illegal drugs, weapons, or self-harm; content that infringes another person's rights; and spam, scams, or deceptive content. Our Community Guidelines set this out in full.
The Software provides in-app tools to report objectionable content and to block abusive users. We review reports and act on them, ordinarily within 24 hours, by removing content and ejecting the users who provided it. Accounts that post objectionable content may be suspended or terminated without notice.
The Software includes third-party and open source components licensed under their own terms, which govern your use of those components and take precedence over this EULA to the extent they conflict. A current list of components and licenses is available on request at info@therr.com.
We may provide updates automatically or through your app store. Some updates are required for the Software to keep working. If you do not install a required update, parts of the Software may stop functioning.
This EULA takes effect when you first install or use the Software and continues until terminated. You may terminate it at any time by uninstalling the Software and deleting your account. It terminates automatically if you breach it. On termination, your license ends and you must stop using and delete all copies of the Software. Sections 3, 8, 9, 10, and 11 survive.
To the fullest extent permitted by law, the Software is provided "as is" and "as available", without warranty of any kind, express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you, and nothing here limits your non-waivable statutory consumer rights.
The limitations of liability in Section 19 of our Terms of Service apply to this EULA and are incorporated by reference.
If you obtained the Software from the Apple App Store or Google Play, the app-store provisions in Section 23 of our Terms of Service apply to this EULA and are incorporated by reference. Among other things, Apple Inc. is a third-party beneficiary of this EULA and may enforce it against you; Apple has no obligation to furnish maintenance or support; and Therr, not Apple, is responsible for the Software and for addressing any claim relating to it.
This EULA is governed by the laws of the State of Texas, without regard to its conflict of laws rules. The dispute resolution provisions in Section 20 of our Terms of Service — including binding individual arbitration, the class action waiver, and your 30-day right to opt out — apply to any dispute under this EULA and are incorporated by reference. If you are a consumer resident in the EEA, the UK, or another jurisdiction with mandatory local consumer protections, those protections are unaffected.
We may update this EULA. If a change is material, we will give you at least 30 days' advance notice by email or a prominent in-app notice before it takes effect and update the "Last updated" date. Continuing to use the Software after the effective date means you accept the change. Changes are not retroactive.
