Therr respects intellectual property rights and expects its users to do the same. This policy explains how to report content on the Service that you believe infringes your copyright, how to respond if your content was removed, and how we handle repeat infringers. It is part of our Terms of Service.

Designated agent for copyright notices

Under the Digital Millennium Copyright Act, 17 U.S.C. §512, Therr has designated the following agent to receive notifications of claimed infringement:

This agent is registered with the United States Copyright Office under service provider identifier DMCA-1076711, and is listed in the Office's public directory of designated agents at dmca.copyright.gov/osp.

The contact above is for copyright notices only. For anything else, including privacy requests, safety reports, and general support, use the channels described in our Community Guidelines and Privacy Policy.

How to submit a notice of claimed infringement

To be effective under the DMCA, your written notice must include substantially all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of them.
  3. Identification of the material that is claimed to be infringing and that you want removed, with enough information for us to locate it — for a Therr post, the direct URL or the username and the date and time of the post.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Send it to the designated agent above. Incomplete notices may not be actionable, and we may ask you for more information.

What we do when we receive a valid notice

  • We remove or disable access to the material expeditiously.
  • We notify the user who posted it, and provide them a copy of your notice — including your name and contact information, which the DMCA requires us to forward. Do not include information in your notice that you are not willing to have shared with the person you are reporting.
  • We record the removal against that user's account as a copyright strike.
  • We tell the user how to file a counter-notice.

Misrepresentation carries consequences

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Consider whether the use might be a fair use before you send a notice. If you are unsure whether the material infringes your rights, consult a lawyer.

Counter-notice — if your content was removed

If you believe your content was removed by mistake or misidentification, you may send a counter-notice to the designated agent above. It must include substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the Western District of Texas), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notice, we will forward it to the person who filed the original notice — including your contact information — and tell them we will restore the material in 10 to 14 business days unless they notify us that they have filed a court action seeking to restrain you from the infringing activity. If they do not, we may restore the material.

Repeat infringer policy

We terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. Our policy:

  • Each piece of content removed in response to a valid DMCA notice is a strike against the account.
  • A strike is withdrawn if the user files a valid counter-notice and the material is restored, or if the complainant retracts the notice.
  • At one strike, we warn the account and explain this policy.
  • At two strikes, we may temporarily restrict the account's ability to post.
  • At three strikes, we terminate the account and prohibit the person from creating a new one.
  • Strikes expire after 24 months.
  • We terminate immediately, without regard to strike count, where the infringement is egregious — for example, uploading commercial works at scale or circumventing an earlier termination.

We keep records of notices, counter-notices, strikes, and enforcement actions, and we act on them. Terminated users may appeal by emailing info@therr.com; a reviewer not involved in the original decision will respond, ordinarily within 14 days.

Trademark and other intellectual property complaints

To report content that misuses your trademark or other intellectual property, email info@therr.com with the subject line "IP Complaint" and include: your name and contact information; the trademark or right at issue and evidence of your rights (for example, a registration number); the location of the content on the Service; and an explanation of why the use infringes. The same good-faith and accuracy expectations apply.
